Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at ergonomicshelp.com, the members' portal at app.ergonomicshelp.com, all courses, memberships, downloads, tools, podcasts, newsletters, coaching services, and community spaces operated by 102544 PEI Inc., operating as ErgonomicsHelp ("ErgonomicsHelp," "we," "us," or "our") — collectively, the "Services."

By creating an account, purchasing a product, subscribing to a list, or otherwise using the Services, you agree to these Terms. If you don't agree, don't use the Services.

1. Eligibility and Accounts

You must be at least 16 years old and able to form a binding contract to use the Services. You're responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly if you suspect unauthorized access.

Accounts are personal. You may not share your login, transfer your access, or use a single account to provide access to multiple individuals or organizations unless we've agreed in writing (for example, through a team or organization license).

2. Our Services

The Services include but aren't limited to:

  • Educational courses such as the Ergonomics Blueprint certification course, the AI for Ergonomics Practice course, the Privacy course, and the Sell Ergonomics / Remote Assessments courses, delivered through the portal as video, audio, slides, and downloadable resources.
  • Memberships, including Accelerate (a monthly or annual membership granting access to the equipment database, infographics, swipe copy, community, live sessions, and member tools), and Mastermind (Accelerate plus one-on-one coaching and priority support).
  • Equipment database with product information, reviews, comparisons, and recommendations.
  • Member tools, including the Privacy Toolkit (File Vault, Text Redactor, Photo Privacy, Metadata Inspector) and other tools we release from time to time.
  • Community spaces, including Discord and on-portal comments, reviews, and forums.
  • Public and members-only podcasts, broadcasts, and newsletters such as "This Week in Ergonomics."
  • Coaching, consulting, and live calls booked through the Services.
  • Free resources, including downloadable PDFs, guides, and previews.

We may add, change, or discontinue features of the Services at any time. We'll give reasonable notice before materially reducing a paid feature you rely on.

3. Payments, Subscriptions, and Renewals

Prices for the Services are shown at checkout. All amounts are in the currency stated at checkout (typically U.S. dollars) and are exclusive of applicable taxes unless stated otherwise.

One-time purchases

Some products, such as the Ergonomics Blueprint course, are sold as one-time purchases granting ongoing access under the terms set out at checkout.

Subscriptions

Memberships such as Accelerate and Mastermind are billed on a recurring basis (monthly or annually). By subscribing, you authorize us, through our payment processor (Stripe), to charge your payment method automatically at the start of each billing period until you cancel. You can cancel any time from your account or by emailing us; cancellation stops future renewals and takes effect at the end of the current paid period. We do not provide prorated refunds for partial periods unless required by law.

Failed payments

If a charge fails, we may retry it and may suspend or downgrade your access until payment is resolved.

Price changes

We may change subscription prices. We'll give existing subscribers at least 30 days' notice of any price increase, and the new price will take effect at your next renewal.

4. Refund Policy

We offer a 30-day, no-questions-asked money-back guarantee on courses and memberships. If you're not satisfied for any reason, email us at support@ergonomicshelp.com within 30 days of your purchase (for courses) or of your most recent billing date (for memberships), and we'll issue a full refund.

Beyond the 30-day window:

  • Memberships — you can cancel any time from your account or by emailing us. Cancellation stops future renewals and takes effect at the end of the current paid period. After the 30-day window, we don't refund partial periods, but we'll consider exceptions for demonstrable billing errors or extenuating circumstances.
  • Coaching calls — unused, prepaid sessions can be rescheduled within a reasonable window; refunds outside the 30-day window are at our discretion.

Where mandatory consumer-protection or distance-selling laws give you a stronger right of withdrawal, those rights apply in addition to this policy.

5. Educational and Professional Disclaimer

The Services provide education, training, tools, and business coaching for ergonomics professionals and adjacent practitioners. They do not provide medical, clinical, legal, financial, tax, or accounting advice.

Information on ErgonomicsHelp is for educational and informational purposes only. It is not a substitute for individualized assessment by a qualified professional, and it is not a diagnosis or treatment plan for any individual. If you are an end-user reading our content, consult an appropriately licensed professional before making changes to your work setup, health routine, or treatment.

Continuing-education claims, where listed, reflect our understanding of provider approvals at the time of publication. Credit determinations and eligibility rules vary by jurisdiction and credentialing body, and may change without notice. We make no guarantee that any course will be accepted by any specific licensing or certifying body for credit toward your individual credential. Verify with your own board or association.

Business and marketing results vary. Testimonials and case studies reflect the experience of specific individuals and are not a guarantee that you will obtain similar results.

6. License and Intellectual Property

All content, including text, videos, audio, slide decks, PDFs, templates, software, designs, the equipment database, reviews authored by us, and the look and feel of the Services, is owned by 102544 PEI Inc. or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual-property laws.

Subject to your compliance with these Terms and your active access tier, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, professional use. Specifically, you may:

  • Stream and view course videos and audio.
  • Download resources, templates, and PDFs marked as downloadable, for your own professional use with your clients.
  • Apply tools, scripts, and frameworks we provide to your own client work.

You may not:

  • Share, resell, sublicense, republish, or redistribute any course content, downloads, recordings, or member-only material outside your own client work.
  • Reproduce or rebrand our materials as your own training or course content.
  • Scrape, harvest, or systematically copy the equipment database, reviews, or other content.
  • Reverse-engineer, decompile, or attempt to extract source code from the Services.
  • Use the Services to train, fine-tune, or evaluate any machine-learning or AI model without our express written permission.
  • Use the Services in any way that violates applicable law.

"ErgonomicsHelp" and our logos are trademarks of 102544 PEI Inc. You may not use them without written permission, except to refer to us truthfully.

7. User-Submitted Content

You may have the opportunity to submit content to the Services — including reviews, comments, community posts, product submissions, lesson feedback, survey responses, and files you upload to portal tools. You remain the owner of your content.

By submitting content, you grant ErgonomicsHelp a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, reproduce, display, adapt, and use your content for the purpose of operating, promoting, and improving the Services. You can request removal of your content at any time.

You represent that:

  • You own or have the rights to submit the content.
  • Your content doesn't violate anyone's rights, including privacy, publicity, intellectual property, or contractual rights.
  • Your content isn't unlawful, defamatory, abusive, harassing, discriminatory, or otherwise objectionable.
  • You won't upload sensitive personal information about third parties (such as identifiable client photographs or medical records) without their consent.

We may remove or edit user-submitted content at our discretion and may suspend or terminate accounts for violations.

8. Community Rules

Our community spaces (Discord, comments, forums, live calls) are for respectful, professional discussion. You agree not to:

  • Harass, demean, threaten, or discriminate against any participant.
  • Share confidential client information or other people's personal data without consent.
  • Promote your own products or services without our permission (outside of normal community sharing about your work).
  • Post spam, scams, multi-level-marketing pitches, or unrelated commercial content.
  • Post illegal content, malware, or content that infringes intellectual-property rights.

We may issue warnings, remove content, suspend access, or terminate accounts for community-rule violations. Discord usage is also governed by Discord's own terms.

9. Acceptable Use of Portal Tools

Some Services let you upload, process, or generate files (such as the Privacy Toolkit). You agree to use these tools only for lawful purposes and only with content you have the right to process. You're responsible for backing up your own data and for verifying any output before relying on it. Tools described as "browser-side" or "local" process your data on your device; tools that send data to our servers are described as such in the tool itself.

10. Third-Party Services

The Services rely on or link to third-party providers (Stripe, Cloudflare, Fly.io, Discord, Buzzsprout, scheduling and email providers, and others). Your use of those services is governed by their respective terms. We are not responsible for third-party services, content, or links.

11. Termination and Suspension

You can cancel your subscription or close your account at any time. We may suspend or terminate your access if you violate these Terms, if your payment method fails, if we're required to by law, or if we discontinue the Services.

On termination, your right to access the Services ends immediately. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive termination.

12. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ErgonomicsHelp disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

We do not warrant that the Services will be error-free, secure, or uninterrupted, that defects will be corrected, or that the information provided will be complete, current, or accurate.

13. Limitation of Liability

To the maximum extent permitted by law, ErgonomicsHelp, its directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Services.

Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).

Some jurisdictions don't allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold ErgonomicsHelp, its directors, officers, employees, contractors, and agents harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) content you submit through the Services.

15. Governing Law and Disputes

These Terms are governed by the laws of the Province of Prince Edward Island and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. You agree that the courts located in Prince Edward Island will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, except where you are entitled under mandatory consumer-protection law to bring a claim in your home jurisdiction.

Before filing any claim, you agree to first contact us at support@ergonomicshelp.com and to attempt to resolve the dispute informally for at least 30 days.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date above and, where appropriate, give notice through the Services or by email. Continued use of the Services after an update constitutes acceptance of the revised Terms.

17. Miscellaneous

  • Entire agreement — these Terms (together with our Privacy Policy and any product-specific terms) form the entire agreement between you and ErgonomicsHelp regarding the Services.
  • Severability — if any provision is held unenforceable, the remaining provisions remain in effect.
  • No waiver — our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment — you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure — we're not liable for delays or failures caused by events beyond our reasonable control.
